Limitations of Liability
To the maximum extent permitted by applicable law, Zenith Asia Research shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the services; (ii) any conduct or content of any third party on the services; (iii) any content obtained from the services; and (iv) unauthorized access, use, or alteration of your transmissions or content.
Governing Law
These Terms shall be governed and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions. Any legal action or proceeding related to your access to, or use of, the Site shall be instituted in a court in Kuala Lumpur, Malaysia. You and Zenith Asia Research agree to submit to the jurisdiction of, and agree that venue is proper in, these courts in any such legal action or proceeding.
Indemnification
Except where prohibited by law, you will hold Zenith Asia Research and its officers, directors, employees, and agents harmless for any indirect, punitive, special, incidental, or consequential damage, however it arises (including attorneys' fees and all related costs and expenses of litigation and arbitration), whether in an action of contract, negligence, or other tortious action, arising out of or in connection with this agreement.
